FavePage Terms of Service

These Terms of Service (or “Terms”) govern your access and use of FavePage, except where we expressly state that separate terms (and not these) apply, and provide information about the FavePage Service (the “Service”), outlined below.
The FavePage Service is provided to you by FavePage, Inc. These Terms of Service therefore constitute an agreement between you and FavePage, Inc. If you do not agree to these Terms, then do not access or use FavePage.
SMS Consent for Communication
The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
Types of SMS Communications
If you have consented to receive text messages from FavePage, you may receive text messages related to app updates, new features, events etc.
Message Frequency
Our SMS message frequency will be up to 2 text messages daily to each user.
Potential Fees for SMS Messaging
Many carriers charge a fee for each message sent or received. This can vary depending on the carrier’s pricing structure and whether the message is sent domestically or internationally. These fees can be based on several factors such as, geographic location, and the type of SMS messaging being used (e.g., transactional, or one-time passwords)
Opt-In Method
Customers will Opt-In for SMS messaging from FavePage through intake forms on their website located at (https://favepage.com/contact), or on the FavePage app. This agreement for SMS will not be shared with third parties or affiliates for marketing purposes.
Opt-out
Customers will be able to opt out of SMS messaging from FavePage by replying STOP at any time to any received SMS message, once opted-out they will receive no further SMS communication. They can Opt back In at any time by replying START

1. The FavePage Service
We agree to provide you with the FavePage Service. The Service includes all of the FavePage products, features, applications, services, technologies, and software that we provide to advance FavePage’s mission: To help you discover, share, and connect over your favorite recommendations and interests. The Service is comprised of the following key elements:
Offering personalized opportunities for creation, connection, discovery, and sharing.
We recognize that our users have diverse interests. We offer features and systems designed to help you create, share, and connect with people and content you care about. We build systems that attempt to understand your and others’ interests to help you find, join, and share experiences that matter to you. This includes highlighting content, features, offers, and accounts that you might find interesting, based on activity both on and off FavePage.
Fostering a constructive, inclusive, and secure environment.
We develop and utilize tools and offer resources to our community to ensure experiences are positive and welcoming. We have teams and systems dedicated to combating abuse, policy violations, and harmful or deceptive behavior. We use all available information to maintain platform security. We may share information about misuse or harmful content with law enforcement or relevant third parties. Learn more in the Privacy Policy.
Developing and leveraging technologies to effectively serve our growing community.
Managing and analyzing information for our community is vital to our Service. A core part of our Service involves creating and using sophisticated technologies to personalize, protect, and enhance FavePage at a vast scale. Automated technologies, including elements of artificial intelligence and machine learning, help ensure the integrity and functionality of the Service. Learn more in the Privacy Policy.
Ensuring global access to our Service.
To operate our global Service, we must store and transfer data across our worldwide systems, which may involve locations outside of your country of residence. This global infrastructure is essential for providing our Service. For more information on how we transfer, store, or process your information, please review our Privacy Policy.
Connecting you with brands, products, and services relevant to you.
We use data from FavePage, and potentially data from third-party partners, to show you advertisements, offers, and sponsored content that we believe will be meaningful. We aim to make this content as relevant as your other experiences on FavePage.
Research and innovation.
We use the information we possess to study our Service and collaborate on research to improve FavePage and contribute to the well-being of our community.
2. How Our Service Is Supported
By using the Service covered by these Terms, you acknowledge that we can display advertisements and sponsored content that businesses and organizations pay us to promote.
We use your data, such as information about your activity and interests, to show you ads that are more relevant to you.
We provide relevant ads without disclosing your identity to advertisers. We do not sell your personal data. We allow advertisers to define their target audience, and we then show their advertisements to users who may be interested.
We also give advertisers reports on the performance of their ads to help them understand how people are engaging with their content. We do not share information that directly identifies you (like your name or email address) unless you give us explicit permission.
You may see promotional content on FavePage posted by account holders who are promoting products or services based on a commercial relationship with the business partner mentioned in their content.
3. The Privacy Policy
Providing our Service requires collecting and utilizing your information. The Privacy Policy explains how we collect, use, and share information. It also details the ways you can control your information, including in the FavePage Privacy and Security Settings. 4. Your Commitments
In exchange for our commitment to provide the Service, we require you to make the following commitments to us.
4.1 Eligibility to Use FavePage.
To ensure the Service is safe, secure, and compliant with the law, you must agree to these restrictions:
- You must be at least 13 years old.
- You must not be prohibited from receiving any aspect of our Service under applicable laws.
- We must not have previously disabled your account for violation of law or any of our policies.
- You must not be a convicted sex offender.
4.2 Prohibited Uses of FavePage.
Maintaining a safe and open Service requires collective cooperation.
- You can’t impersonate others or provide false information. While you may not need to disclose your full legal identity, you must provide us with accurate and up-to-date information (including registration information). You may not impersonate someone you are not, nor can you create an account for someone else without their express permission.
- You can’t engage in anything unlawful, misleading, fraudulent, or for an illegal or unauthorized purpose.
- You can’t violate (or help or encourage others to violate) these Terms or our policies, including our Community Standards.
- You can’t interfere with or impair the intended operation of the Service. This includes misusing any reporting, dispute, or appeals channel.
- You can’t attempt to create accounts or access or collect information in unauthorized ways. This includes automated creation or collection without our express permission, regardless of whether you are logged into a FavePage account.
- You can’t sell, license, or purchase any account or data obtained from us or our Service. This includes attempts to buy, sell, or transfer any part of your account (including your username).
- You can’t post someone else’s private or confidential information without permission or do anything that violates someone else’s rights, including intellectual property rights. You represent you own or have obtained all necessary rights to the content you post or share.
- You can’t modify, translate, create derivative works of, or reverse engineer our products or their components.
- You can’t use a domain name or URL in your username without our prior written consent.
- You can’t do, or attempt to do, anything to circumvent, by-pass, or override any technological measures that control or limit access to the Service or data.
4.3 Permissions You Grant to Us.
As part of this agreement, you grant us the permissions necessary to provide the Service.
- We do not claim ownership of your content, but you grant us a license to use it. Your rights to your content remain yours, and you are free to share your content with anyone else. However, we require a legal permission (a “license”) to operate the Service. When you share, post, or upload content covered by intellectual property rights (like photos or videos) on or in connection with our Service, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This license will terminate when your content is deleted from our systems. You can delete content or your account to initiate deletion.
- Permission to use your username, profile picture, and relationship information for sponsored content. You give us permission to display your username, profile picture, and information about your actions (like “likes”) or relationships (like “follows”) near or in connection with accounts, ads, and other sponsored content that you follow or engage with, without any compensation to you. We will honor your ad settings.
- You agree that we can download and install updates to the Service on your device.
5. Additional Rights We Retain
- If you select a username, we may change it if we believe it is appropriate or necessary (e.g., if it infringes IP rights or impersonates another user).
- If you use content covered by intellectual property rights that we own and make available in our Service (e.g., images, designs, or sounds we provide), we retain all rights to our content (but not yours).
- You can only use our intellectual property, trademarks, or similar marks as expressly permitted by our Brand Guidelines or with our prior written permission.
- You must obtain written permission from us or an open source license to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
6. Content Removal and Disabling or Terminating Your Account
We can remove any content or information you share if we believe that it violates these Terms of Use, our policies (including our Community Standards), or if we are permitted or required to do so by law.
We can refuse to provide or stop providing all or part of the Service to you (including terminating or disabling your access) immediately to protect our community or services, or if you create a risk or legal exposure for us, violate these Terms or our policies, if you repeatedly infringe other people’s intellectual property rights, or where we are permitted or required to do so by law.
If you believe your account has been terminated in error, or you wish to disable or permanently delete your account, you may make a request at www.favepage.com/contact.
When you request to delete content or your account, the deletion process will automatically begin no more than 30 days after your request. It may take up to 90 days to delete content after the deletion process begins. While the deletion is underway, the content is no longer visible to other users but remains subject to these Terms and our Privacy Policy. After deletion, it may take us up to another 90 days to remove it from backups and disaster recovery systems.
Content will not be deleted within the 90-day period in the following situations:
- Where your content has been used by others in accordance with this license and they have not deleted it (in which case this license will continue to apply until that content is deleted); or
- Where deletion within 90 days is not possible due to technical limitations of our systems, in which case, we will complete the deletion as soon as technically feasible; or
- Where deletion would restrict our ability to: investigate or identify illegal activity or violations of our terms and policies; protect the safety and security of our products, systems, and users; comply with a legal obligation; or comply with a request of a judicial or administrative authority, law enforcement, or a government agency; in which case, the content will be retained only as long as necessary for those purposes.
If you delete or we disable your account, or if this contract is otherwise terminated, the following sections will still apply: this section, the section above called “Your Commitments,” and the section below called “Our Agreement and What Happens if We Disagree.”
7. Our Agreement and What Happens if We Disagree
7.1 Our Agreement.
- If you use certain other features or related services, you will be provided with an opportunity to agree to additional terms that will also become a part of our agreement. If any of those terms conflict with this agreement, those other terms will govern.
- If any aspect of this agreement is unenforceable, the rest will remain in effect.
- Any amendment or waiver to our agreement must be in writing and signed by us. Our failure to enforce any aspect of this agreement will not constitute a waiver.
- We reserve all rights not expressly granted to you.
7.2 Who Has Rights Under this Agreement.
- Our past, present, and future affiliates and agents can invoke our rights under this agreement. Otherwise, this agreement does not give rights to any third parties.
- You cannot transfer your rights or obligations under this agreement without our consent.
- Our rights and obligations can be assigned to others.
7.3 Who Is Responsible if Something Happens.
- Our Service is provided “as is,” and we can’t guarantee it will be safe and secure or will work perfectly all the time. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- We do not control what people do or say, and we are not responsible for their (or your) actions or content (including unlawful or objectionable content). We are also not responsible for services and features offered by other people or companies, even if you access them through our Service.
- Our responsibility for anything that happens on the Service (also called “liability”) is limited as much as the law will allow. You agree that we won’t be responsible (“liable”) for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms. Our total liability arising out of or relating to these Terms will not exceed the greater of $100 or the amount you have paid us in the past twelve months.
- You agree to defend (at our request), indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including attorney’s fees and costs) arising out of or in any way connected with these Terms or your use of the Service.
7.4 How We Will Handle Disputes.
- Except as provided below, you and we agree that any cause of action, legal claim, or dispute between you and us arising out of or related to these Terms or FavePage (“claim(s)”) must be resolved by arbitration on an individual basis. Class actions and class arbitrations are not permitted.
- Instead of using arbitration, you or we can bring claims in your local “small claims” court. If not brought in small claims court, the claims must be resolved by binding, individual arbitration. You and we expressly waive a trial by jury.
- The following claims do not have to be arbitrated: disputes related to intellectual property, violations of our Platform Policy, or unauthorized efforts to interfere with the Service.
- This arbitration provision is governed by the Federal Arbitration Act.
- You can opt out of this provision within 30 days of the date you agreed to these Terms. To opt out, you must send your name, residence address, username, email address or phone number you use for your FavePage account, and a clear statement that you want to opt out of this arbitration agreement to support@favepage.com.
- Before you commence arbitration, you must provide us with a written Notice of Dispute that includes your name, residence address, username, email address or phone number you use for your FavePage account, a detailed description of the dispute, and the relief you seek. Any Notice of Dispute you send to us should be mailed to FavePage, Inc. 2900 N. University Drive, Coral Springs, FL 33076 or sent via email to support@favepage.com.
- For any claim that is not arbitrated or resolved in small claims court, you agree that it will be resolved exclusively in Broward County, Florida. You also agree to submit to the personal jurisdiction of this court.
- The laws of the State of Florida will govern these Terms and any claim, without regard to conflict of law provisions.
7.5 Unsolicited Material.
We appreciate feedback or other suggestions, but may use them without any restrictions or obligation to compensate you for them, and are under no obligation to keep them confidential.
8. FavePages Business Participation Disclaimer
By creating a FavePage profile for your business or professional services and promoting the FavePage platform to your customers, you acknowledge and agree to the following:
- Open Marketplace - FavePage is an open platform that allows multiple businesses and professionals—including those offering similar or competing products and services—to create profiles and advertise to users.
- Competitor Visibility - Your customers and followers who download the FavePage app may be shown promotions, sponsored placements, and listings from other businesses, including direct competitors in your category or related categories.
- No Exclusivity - Participation in FavePage does not grant any exclusivity over customer visibility, traffic, or promotional placement within the app.
- Sponsored Placement - Sponsored positions and promotional opportunities within FavePage are available to multiple businesses and may be subject to change, rotation, or competitive bidding.
- Voluntary Participation - You understand that promoting FavePage to your customers is voluntary, and you accept that other businesses may benefit from increased user activity on the platform.
- Acceptance - By signing below (physically or digitally), you confirm that you understand and accept the terms above as a condition of participation in the FavePage platform.
9. Updating These Terms
We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to these Terms and give you an opportunity to review them before they go into effect. If you continue to access or use the Service, you will be bound by the updated Terms. If you do not agree to any updated Terms, you can terminate your agreement by deleting your account and no longer accessing or using FavePage.
FavePage Community Standards
These Community Standards outline what is and isn’t allowed on FavePage. They apply to all users and all content (including posts, comments, profile information, and shared recommendations) posted on our Service. Violating these standards may result in content removal, account suspension, or termination.
1. Safety and Protection
We are committed to creating a safe environment where users feel comfortable sharing and discovering recommendations.
Violent and Criminal Content
Do not post content that promotes, encourages, or coordinates violence, serious harm, or illegal acts. This includes:
- Content depicting or threatening severe violence or physical harm against individuals or groups.
- Content supporting or praising terrorist organizations, organized hate groups, or criminal activity.
- Instructions on how to manufacture weapons, explosives, or illegal drugs.
Hate Speech and Discrimination
We prohibit content that attacks, degrades, intimidates, or encourages hostility against individuals or groups based on protected characteristics, including race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender identity, disability, or serious disease.
Harassment and Cyberbullying
Do not engage in harassment, bullying, or abusive behavior targeting private individuals. This includes:
- Sharing non-consensual intimate images.
- Repeated, unwanted contact or communication intended to intimidate or degrade.
- Posting or threatening to post sensitive personal information (doxxing).
Self-Harm and Dangerous Content
We do not allow content that encourages or provides instructions for self-harm, suicide, or eating disorders. We prioritize providing resources to users struggling with these issues.
Sexual Exploitation and Nudity
We strictly prohibit the sexual exploitation of children. We also restrict the sharing of sexually suggestive or explicit content, particularly non-consensual sexual content.
2. Integrity and Authenticity
FavePage works best when users trust the recommendations and the people providing them. We require honest and transparent use of the platform.
Impersonation
Do not impersonate individuals, brands, or organizations in a way that is intended to mislead, confuse, or deceive others. Parody accounts must clearly state that they are not affiliated with the entity being parodied.
Spam and Manipulation
Do not engage in activity that disrupts the experience of other users, including:
- Mass-producing or repeatedly posting identical content or recommendations.
- Using unauthorized automation or scripting to artificially collect followers, likes, or interactions.
- Creating fake accounts or networks of deceptive accounts to manipulate recommendations or trends.
Misinformation and Deception
We do not allow content that promotes verifiable false information that could lead to public harm (e.g., misinformation about public health, voting, or civil processes).
Financial Scams and Fraud
Do not use FavePage to conduct fraud, scams, or other deceptive financial practices, including promoting unauthorized “get rich quick” schemes.
3. Intellectual Property and Privacy
Respecting the rights of others, including their intellectual property and privacy, is a fundamental rule on FavePage.
Intellectual Property Rights
Do not post content that infringes on the copyright or trademark rights of others. If you are sharing third-party content, you must have the necessary licenses or permissions, or the use must fall under applicable legal exceptions (like fair use).
Private Information
Do not share another person’s private or confidential information without their explicit consent. This includes, but is not limited to, private financial information, physical addresses, or phone numbers.
Authentic Content
You must only upload content that you have created or that you have the rights to use.
4. Commercial Integrity and Regulated Goods
Content related to commercial transactions must adhere to both our policies and legal restrictions.
Illegal Sales and Restricted Goods
Do not facilitate or promote the sale, purchase, or trade of:
- Illegal drugs or pharmaceuticals.
- Firearms, ammunition, or explosives.
- Products that facilitate illegal activities.
- Endangered or illegally harvested wildlife.
Branded Content and Endorsements
If you are paid to promote a product, service, or recommendation, you must clearly and conspicuously disclose the commercial relationship, adhering to all applicable regulations (e.g., FTC guidelines).
5. Reporting and Enforcement
We rely on our community to help enforce these standards.
Reporting Violations
If you see content or behavior that violates these standards, please use the reporting tools available in the FavePage application or on our website at www.favepage.com/contact.
Enforcement Actions
We may take several actions against accounts and content that violate these standards, including:
- Removing the offending content.
- Restricting the visibility of the account.
- Suspending or permanently terminating the account.
- Notifying law enforcement if a violation involves credible threats of violence or illegal activity.
Appeals
If you believe we have removed your content or disabled your account by mistake, you may be able to appeal the decision through our Help Center.
These FavePage Community Standards are subject to change. We will notify the community of significant updates.
